These Digital Art Terms of Service ("Terms") govern the use of services provided by AgonyArt (blunt.beauti).
By purchasing, downloading, or using any digital art ("Art"), you ("Client" or "User") agree to be bound by these Terms.

1. Acceptance of TermsBy accessing or using the digital art services provided by me, you agree to abide by these Terms. If you do not agree to these Terms, do not use our services.2. License to Use the ArtUpon purchasing or commissioning digital art, you are granted a non-exclusive, non-transferable, revocable license to use the Art for personal or commercial purposes, as outlined in the agreement.
This license does not transfer ownership of the Art, and you may not claim the Art as your own.
Commercial use includes but is not limited to use in advertising, merchandise, or other commercial ventures.
If commercial use is intended, the terms for this must be agreed upon beforehand and may involve an additional fee.
3. Art OwnershipI retain all rights, ownership, and intellectual property associated with the Art, including the right to display, distribute, and modify it, unless explicitly stated otherwise.
For commissioned pieces, the client may request specific exclusivity or customizations to ownership.
These terms should be discussed and documented in a separate agreement prior to commissioning.
4. Commissioning Digital ArtWhen commissioning a custom piece, you agree to provide clear and accurate details regarding your vision and requirements.
I am not responsible for delays or issues arising from unclear or incomplete instructions.
I will provide progress updates for custom works and require feedback during the process.
Any changes after approval may be subject to additional charges.
Refund Policy. Once a commission has been started, no refunds will be provided unless explicitly agreed upon due to failure to meet the agreed-upon terms.
5. Prohibited UsesYou may not use the Art for any of the following purposes:
Engaging in illegal activities.
Defamation, hate speech, or promotion of violence.
Altering or selling the Art without prior consent from the creator.
Using the Art to create infringing or counterfeit products.
Using the Art to train AI.
6. Modifications and RevisionsMinor revisions or changes to commissioned artwork are generally allowed within the scope of the original agreement.
However, significant revisions may incur additional costs.
Once the art is finalized and delivered, further modifications will be considered a new commission and subject to a new agreement.
7. Delivery and File TypesArt will be delivered in agreed-upon formats (e.g., .jpg, .png, .tiff, .psd), unless otherwise specified.
Digital artwork is typically delivered via email or through discord direct messages.
8. Payment and PricingPrices for digital art services will vary depending on complexity, medium, and usage rights. All prices are provided upfront and agreed upon before work begins.
Payments are generally required in full, or at least a 50% deposit before starting a commission.
Remaining balances are due upon delivery of the final product.
Payments are accepted through Ko-Fi or PayPal.
All fees are in GBP.
9. Copyright and AttributionYou are not required to credit the creator of the Art in most cases, but I encourage attribution when possible.
Any use of the Art for public or commercial purposes must acknowledge the creator, where applicable.
The creator may use the completed Art for promotional purposes, including portfolio use, social media, and advertising, unless otherwise agreed upon in writing.
10. LiabilityI am not liable for any damages, loss of business, or misuse of the Art after delivery.
I am not responsible for issues arising from the printing, reproduction, or distribution of the Art.
11. Termination of LicenseI reserve the right to revoke or terminate the license granted to use the Art if these Terms are violated.
This includes any unauthorized use, modification, or resale of the Art.
12. Refund and Cancellation PolicyRefunds will only be issued for unused, unfinished commissions.
Cancellations are allowed within the first 5 days of the project initiation.
After the cancellation period, no refunds are provided.
13. Dispute ResolutionIn the event of a dispute, both parties agree to first attempt to resolve the issue through amicable negotiations.
If the dispute cannot be resolved informally, it will be subject to binding arbitration in accordance with UK laws.
14. Changes to TermsI may update or amend these Terms at any time.
Changes will be posted on this page with an updated date.
By continuing to use my services after any modifications, you accept the new terms.
